Recently, the Party Working Committee of Daqiao Sub-district has signed an agreement with the Party Committee of the Judicial Bureau of Yangpu District which allows the legal advisors to come into the community and provide legal services for the residents in the community, marking the official beginning of the initiative of legal services coming into communities.

　　According to the reporter, there are a number of problems obviously in the current law-based social governance at the basic level. For example, the organization or the individual at the basic level has a quite generalized understanding of right; while they are defending their rights, they are compromising the social and public benefits. The demand for legal services is increasingly high, but the supply is rather vulnerable and unsustainable because it is non-for-profit. Forms take precedence over the functions when it comes to review and assessment meeting, public hearing and coordination meeting, which leads to the residents’ poor engagement in the community’s public affairs. To take it further, someone thinks the law is made for the others, but not for himself, and there is a general thought that the law won’t punish the mass. Besides, the organizations at the basic level (the residents’ committee, the property management committee) won’t cooperate with each other.

　　“All of these have fundamentally demonstrated a lack of legal awareness and a misunderstanding of legal governance. The launch of legal advisors coming into community event is such an effective response to these problems,” said the related person in charge of Daqiao Sub-district. The enhancement of legal services in communities is in line with the Party’s theories of “the mass”, and will be a driver to the development of democracy and legal governance at the basic level. It will provide guidance to the people at the basic level to behave in accordance with the laws, and to solve the problems and conflicts with the laws.

　　Decision-making in the community’s daily work usually needs to be informed with professional legal knowledge, and the legal advisors are exactly the ones who will suit this need, “for example, they could be of assistance in drafting, reviewing and revising the community’s self-governed regulations and residents’ conventions, and provide legal advice and suggestions to the community’s residents and social management and the conduction of daily work, guiding the community on the road of legal governance.”

　　In channeling and placing of the Shanghainese households on Weinan Road which moved back from the other cities, and solving the problems in community property management, these legal advisors are the key in meeting the residents’ demand for legal consultation and legal help. “Nowadays, residents are very legally aware. But sometimes they don’t know how to protect their legal rights. The legal advisors are to answer the residents’ legal questions they have encountered in daily life, and provide legal advice to them, ” said the related person in charge of the sub-district.
